Definitions

For this Privacy Policy:

Account means a unique account created for You to access Our Application or parts of Our Application.

Application means the Company's software program downloaded by You on any Device, named "WH Homeowner."

California Consumer Privacy Act (CCPA) refers to the California Consumer Privacy Act, Cal. Civ. Code 1798.100 seq., and any applicable regulations, as amended from time to time.

Company, We, Us or Our refers to West Hill Global, Inc., 800 Battery Ave Se Suite 100 Atlanta, GA 30339. The Company may be a "data controller" within the meaning of the GDPR and a "business" within the meaning of the CCPA.

Cookies means cookies, web beacons, and other similar tracking technologies.

Device means any device that can access the Service, such as a computer, a cell phone, or a digital tablet.

General Data Privacy Regulations (GDPR) refers to the General Data Privacy Regulations, European Parliament and Council of European Union (2016) Regulation (EU) 2016/679, as may be amended from time to time.

Independent Privacy Ombudsman refers to Baldini Lang, LLC, a third party law firm acting as a privacy ombudsman for the Company to provide you with an independent mechanism to resolve any disputes or concerns you may have regarding this Policy or our privacy practices.

Personal Data means any information that identifies, relates to, describes, or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You. Under the GDPR, Personal Data means any information relating to You, such as a name, identification number, location data, online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity. Personal Data does not include aggregated and de-identified data.

Privacy Policy refers to this Privacy Policy, including the GDPR Privacy Policy Addendum or CCPA Privacy Policy Addendum (if applicable to You).

Sale or Sell, for the CCPA, means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, Your Personal Data to another business or a third party for monetary or other valuable consideration.

Service refers to the Application and/or the Website.

Service Provider means any natural or legal person who processes data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, provide the Service on behalf of the Company, perform services related to the Service, or assist the Company in analyzing how the Service is used. Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself. Usage Data includes, but is not limited to, information such as Your Device's Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. You may be a "data subject" or a "user" within the meaning of the GDPR and a "consumer" within the meaning of the CCPA.

The types of Personal Data that We may collect depends on which of Our Services You are utilizing. Generally, We may collect the following types of Personal Data:

  • Information pertaining to Your transactions with Us, Our Affiliates, and others.

Usage Data.

Usage Data is collected automatically when using the Service. Typically, the information We collect automatically is statistical data and does not include Your personal information, but We may maintain it or associate it with Personal Data we collect in other ways or receive from third parties. It helps Us to improve Our Service and to deliver a better and more personalized service, including by enabling Us to estimate our audience size and usage patterns and store information about users' preferences.

Data Collected While Using Our Application.

While using Our Application, to provide features of Our Application, We may collect, with Your prior permission:

  • Information regarding Your location; and
  • Pictures and other information from Your Device's camera and photo library.

We use this information to provide features of, improve, and customize Our Service and the Application. The information may be uploaded to the Company's servers and/or a Service Provider's server or stored on Your device.

You can enable or disable access to this information at any time through Your Device settings.

CCPA-Defined Categories of Data Collected.

The Personal Data We collect, as described above, may include the following CCPA-defined categories:

    1. Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, internet protocol address, email address, Account name, social security number, driver's license number, passport number, or other similar identifiers.
    2. Any categories of personal information described in Cal. Civ. Code § 1798.80(e), including a name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. Some personal information included in this category may overlap with other categories.
    3. Characteristics of protected classifications under California or federal law, including age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth, and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information).
    4. Commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
    5. Biometric information, including genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data.
    6. Internet or other electronic network activity information includes browsing history, search history, and information regarding a consumer's interaction with an internet website, application, or advertisement.
    7. Geolocation data, including physical location or movements.
    8. Sensory data including audio, electronic, visual, thermal, olfactory, or similar information.
    9. Professional or employment-related information, including current or past job history or performance evaluations, job title.
    10. Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99), including Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, student disciplinary records.
    11. Inferences drawn from any of the above information to create a profile about a consumer reflect the consumer's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

Sources of Data We Collect.

We obtain the categories of Personal Data listed above from the following categories of sources:

  • Directly from You. For example, from documents that You provide to Us related to the Services for which You engage Us.
  • Indirectly from You. For example, through information, We collect from You in the course of providing Services to You.
  • Directly and indirectly from activity on Our Service. For example, from submissions through Our Website portal or Data Usage details collected automatically from the Website and/or the Application.
  • From third-parties that interact with Us in connection with the Services We perform. For example, from third-party Service Providers.

Using Your Personal Data

How We Use Your Personal Data.

The Company may use or disclose Personal Data for the following purposes:

The Company will not collect additional Personal Data categories or use the Personal Data We collected for materially different, unrelated, or incompatible purposes without either providing You notice, updating the Privacy Policy as provided herein, or obtaining Your consent.

Disclosing Your Personal Data

When We Share Your Personal Data.

We may share or disclose Your Personal Data in the following situations:

  • With Service Providers. We may disclose Your Personal Data with Service Providers to perform, monitor, and analyze our Service and to contact You.

In the preceding twelve (12) months, We may have disclosed the following categories (from the "CCPA-Defined Categories of Data Collected" listed above) of Personal Data for a Business Purpose:

  • Category B: California Customer Records personal information categories.

We do not Sell Your Personal Data.

Keeping Your Personal Data

Retention of Your Personal Data.

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy, including to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Our Service does not currently respond to Do Not Track (DNT) signals.

Children's Privacy

Our Service does not address anyone under the age of 18. We do not knowingly collect personally identifiable information from anyone under the age of 18. Any disclosures We provide will only cover the 12 months preceding the verifiable consumer request's receipt.  The response We provide will also explain why We cannot comply with a request, if applicable.

We cannot respond to Your request or provide You with Personal Data if We cannot verify Your identity or authority to make the request and confirm the Personal Data relates to You.  Making a verifiable consumer request does not require You to create an Account with Us.  We will only use Personal Data provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
